The mother and friends of the deceased plan to prove that his death in jail was caused by severe torture.

A new twist has occurred in the case of Hermitage Capital Foundation lawyer Sergey Magnitsky’s death at Matrosskaya Tishina (Sailor’s Silence) detention center in Moscow in 2009. The lawyer’s friends and family have learned that investigators initially had strong evidence indicating that he was tortured and killed in jail, though it was presented simply as negligence on the part of medical staff. Now, Magnitsky’s mother is asking the Investigation Committee to file a criminal case against Prosecutor General Yury Chaika, staff members of the Interior Ministry, the FSB, the Federal Penitentiary Service (FSIN) and 11 judges, who, according to her, are responsible for her son’s death.

Magnitsky’s friends and mother have obtained a document revealing new circumstances of his death. As it turns out, on November 19, 2009, three days after the lawyer’s death in the surgical ward at Matrosskaya Tishina, investigator Levin issued a report to the head of Moscow’s Preobrazhensky District Investigation Department.

In the document, the investigator writes that, based on the investigation documents into Magnitsky’s death, he sees every reason to file a criminal case under Article 105 of the Criminal Code (Premeditated murder) and Article 111 (Intentional infliction of grave bodily injury causing health impairment). As evidence, he cites the conclusions of the forensic examination.

“Experts have identified traces of beatings on Sergey’s body, including damaged knuckles on both hands, numerous grazes and bruises, puncture wounds on the tongue, as well as a suspected head injury,” says one of Hermitage Capital Management lawyers.

On the same day, the investigator’s report was registered in the book of records on crime under No. 582.
Despite this fact, on November 24, 2009, investigators filed a criminal case on Magnitsky’s death under the article on negligence. The lawyer’s colleagues learned that the key role in the investigators’ decision was not played by forensic examination, but by testimonies issued by the Matrosskaya Tishina personnel.

“Investigators are relying on the testimonies of detention facility personnel, who are hiding their involvement in Magnitsky’s death and presenting their version of his death as ‘established facts’,” reads a statement, written by the deceased lawyer’s mother.

Magnitsky’s friends also explain why he was killed.

“Sergey was tortured into not revealing the identities of law enforcement and tax agency personnel who, according to him, were involved in stealing 5.4 billion rubles from the budget,” explains one of the Hermitage Capital Management employees.

Due to the new circumstances, Magnitsky’s mother is seeking to file a criminal case against the officials and law enforcement agents who, according to her, were involved in “the illegal arrest, torture, and murder” of her son. The list includes Prosecutor General Yury Chaika, staff members of the Interior Ministry, the FSB, FSIN, and 11 judges.

Representatives of the Investigation Committee are not commenting on the reports made by Magnitsky’s friends and mother.

“We have not yet received any statements. Therefore there is nothing to talk about at this time,” said representatives of the Investigation Committee’s media relations office.

The possibility that Sergey Magnitsky was murdered in jail had earlier been expressed by Russian human rights activists.

“When Magnitsky began suffering from pancreatitis, the detention center’s physician, Aleksandra Gauss, called for a security convoy. The lawyer was handcuffed and placed in an isolation cell,” says the head of the Public Oversight Commission of Moscow, Valery Borshchev, who conducted an independent investigation into the causes of Magnitsky’s death. “When ‘emergency’ doctors came to the cell, the detainee was already dead. Bruises were discovered on his body, as well as evidence indicating the use of a rubber truncheon against him.”

In the 2011 report to President Dmitry Medvedev, human rights activists also reported that Magnitsky died as a result of beatings and torture.

So far, there are only two suspects in the Magnitsky case. On August 12, 2011, the Investigation Committee presented accusations against Matrosskaya Tishina physicians Larisa Litvinova and Dmitry Kratov, accusing them of negligent homicide.

Both physicians are currently ill and have been hospitalized in the capital, so for now they cannot officially be involved in the investigation. The Investigation Committee suspects that the defendants are pretending to be ill and has already ordered a special examination to be conducted.
