Russia: Third Anniversary of Magnitskiy’s Death

We honor the memory of Russian lawyer Sergey Magnitskiy, who died Nov. 16, 2009 in a Moscow prison after making corruption allegations. Despite widely-publicized, credible evidence of criminal conduct resulting in Magnitskiy’s death, Russian authorities have failed to bring to justice those responsible. While we recognize that negligence charges are being pursued against a prison official, we will continue to call for full accountability for those responsible for Magnitskiy’s unjust imprisonment and wrongful death. We will also continue to fully support the efforts of those in Russia who seek to bring these individuals to justice.

Russia Vows to Avenge U.S. Visa Bans for Russian Officials

Russian will not leave U.S. “attempts to interfere in our domestic affairs” without response, Foreign Ministry spokesman Alexander Lukashevich said on Thursday, referring to visa sanctions imposed on Russian officials allegedly linked to the controversial death of Russian lawyer Sergei Magnitsky in a Moscow pretrial detention center.

“The Russian Foreign Ministry’s attention was drawn to statements by U.S. Ambassador to Moscow Michael McFaul that U.S. entry bans for some of our country’s officials in the contest of the Magnitsky case were in line with the [U.S.] administration’s policy in the human rights sphere,” Lukashevich said.

“We consider such presentation of a problem unacceptable as it runs against not only the character of Russian-U.S. relations, but also the universally accepted principle of presumption of innocence,” he added.

Moscow has “repeatedly warned that such attempts to interfere in our domestic affairs will not be left without response,” he said.

Magnitsky, an anti-corruption lawyer who worked with the Hermitage Capital investment fund, died in Moscow’s infamous Matrosskaya Tishina pretrial detention center in November 2009, a year after he was arrested on tax evasion charges. Shortly before his arrest, he claimed to have uncovered a massive fraud in which Moscow tax and police officials had allegedly embezzled $230 million of budget funds.

Investigation of Magnitsky’s Death ‘Inadequate’ – U.S.

Russia’s investigation into the death of lawyer Sergei Magnitsky has been “inadequate,” U.S. Department of State Spokesperson Victoria Nuland said.

“The investigation into the circumstances of Magnitsky’s death has been inadequate and has failed to produce justice,” Nuland said.

“We continue to call on Russian authorities to conduct a genuine investigation, to prosecute and punish those responsible for Magnitsky’s death,” she added.

Arrested on tax evasion charges just days after accusing police investigators in a $230 million tax refund fraud, Magnitsky died after almost a year in the Matrosskaya Tishina pre-trial detention center in Moscow in November 2009.

U.S. State Department urges Russia to punish those responsible for Magnitsky’s death

The United States continues to urge Russia to bring to account those responsible for the death of Hermitage Capital Investment Fund lawyer Sergei Magnitsky.

Magnitsky, who was accused of corporate tax evasion in relation to his work for the Hermitage Capital investment fund died in an investigative isolation ward in November 2009. According to the Prosecutor General’s Office, his death was caused by cardiovascular insufficiency.

The criminal case against Magnitsky was terminated by the Investigative Committee due to his death, but the Prosecutor General’s Office decided to resume the investigation.

U.S. Reiterates Demand for Justice in Magnitsky Case

Days after Russian authorities decided to try lawyer Sergei Magnitsky posthumously, the U.S. Department of State reiterated its calls to bring those guilty for his death in detention to justice.

Investigators of the Interior Ministry said on Tuesday they were ready to submit the case of the late Sergei Magnitsky, a Hermitage Capital auditor, and Hermitage Capital CEO William Browder to court.

“Pursuing criminal charges against Sergei Magnitsky serves no purpose other than to deflect attention away from the circumstances surrounding this tragic case,” office of the spokesperson said in a statement.

“We’ve seen the press reports about the reopening of the Magnitskiy case,” Department of State Spokeswoman Victoria Nuland told a press briefing earlier in the day. “We continue to call for Russian authorities to bring those responsible for Sergei Magnitskiy’s death to justice.”

State Department unaware Russia trying dead anti-corruption lawyer

The State Department had a response ready at today’s press briefing in case it was asked about the trial of those responsible for the death of Russian anti-corruption lawyer Sergei Magnitsky. The problem is that the Russian’s aren’t trying his killers — they are trying Magnitsky himself — even though he died over two years ago.

On Feb. 7, the New York Times reported that the Russian government is moving forward with tax evasion charges against Magnitsky, even though he died in detention in November 2009, reportedly after being abused and then refused medical attention by his captors. The title of the article was “Russia Plans to Retry Dead Lawyer in Tax Case.”

Asked about the plan to try Magnistky posthumously at Thursday’s press briefing, spokeswoman Victoria Nuland read from her briefing book the following comment:

“We’ve seen the press reports about the re-opening of the Magnitsky case. We continue to call for Russian authorities to bring those responsible for Sergei Magnitsky’s death to justice.”
